These Terms and Conditions govern your use of the Red Phoenix Ballroom website and your purchase or participation in dance lessons, packages, workshops, coaching, choreography, and related services offered by Red Phoenix Ballroom and Melinda Piekstra (“Red Phoenix Ballroom,” “we,” “us,” or “our”).
By using this website, purchasing a service, or scheduling a lesson, you agree to these Terms and Conditions.
1. Dance Instruction and Services
Red Phoenix Ballroom provides private dance instruction, couples instruction, wedding dance preparation, choreography, workshops, competition coaching, and related dance services.
Lesson content and teaching methods may be personalized according to each student’s goals, experience, abilities, and progress. Purchasing lessons does not guarantee a particular level of proficiency, competition result, performance outcome, or completion within a particular number of lessons.
2. New Student Introductory Offer
Unless otherwise stated at checkout, the New Student Introductory Offer includes four personalized 45-minute private dance lessons.
The offer:

Is available to new Red Phoenix Ballroom students only.

May be purchased once per individual or couple.
-
May be used by one individual or by one couple learning together.

Must be paid in full before lessons are provided.

Must be completed within 45 days of purchase.

May not be combined with another discount or promotional offer.
-
Has no cash value and may not be resold.
A partner and previous dance experience are not required.
Failure to schedule or complete the lessons within the applicable 45-day period does not automatically extend the package or entitle the purchaser to a refund. Red Phoenix Ballroom may approve an extension in exceptional circumstances at its sole discretion.
3. Other Lesson Packages and Services
The number, length, price, expiration period, and conditions of other lesson packages or services will be displayed at checkout or communicated at the time of purchase.
If the terms accompanying a specific service differ from this page, the terms presented for that particular purchase will control.
4. Scheduling
Lessons are available by appointment and are subject to instructor and studio availability. Purchasing a package does not reserve specific lesson dates or times.
Students are responsible for scheduling their lessons early enough to complete them before the package expiration date. Red Phoenix Ballroom cannot guarantee preferred appointment times, particularly when scheduling is requested near the expiration date.
Students who arrive late will receive the remainder of their scheduled appointment. A late arrival will not ordinarily extend the lesson or reduce the amount charged.
5. Cancellations and Rescheduling
A minimum of 24 hours’ notice is required to cancel or reschedule a lesson.
Lessons canceled with less than 24 hours’ notice, missed appointments, and no-shows will be charged in full or deducted from the applicable package.
Red Phoenix Ballroom may make a limited exception for a sudden emergency, serious illness, or injury at its discretion. An exception provided on one occasion does not waive the cancellation policy for future appointments.
If Red Phoenix Ballroom must cancel a lesson, the lesson will be rescheduled without penalty or returned to the student’s available package balance.
6. Payments
Payment is required according to the terms shown at checkout. Payments may be processed by a third-party payment provider, such as Stripe. By submitting payment information, you authorize the payment provider to charge the stated amount using your selected payment method.
You agree to provide current, complete, and accurate billing and contact information.
Red Phoenix Ballroom does not directly store complete payment-card information. Payment processing is subject to the payment provider’s applicable terms and privacy practices.
7. Refunds
Purchases are nonrefundable except where required by law or when Red Phoenix Ballroom is unable to provide the purchased service.
A change in schedule, loss of interest, failure to attend, failure to complete lessons before expiration, or failure to provide the required cancellation notice does not ordinarily qualify for a refund.
When appropriate, Red Phoenix Ballroom may offer an account credit, package transfer, or extension at its sole discretion. Any accommodation offered in one situation does not create an obligation to provide the same accommodation in another situation.
Nothing in these Terms limits any rights that cannot legally be waived under applicable law.
8. Physical Activity, Health, and Safety
Dance instruction involves physical activity and carries inherent risks, including slips, falls, collisions, muscle soreness, strains, and other injuries.
By participating, you confirm that you are physically able to take part in dance instruction or have obtained appropriate medical guidance. You are responsible for informing your instructor of any injury, medical condition, physical limitation, balance concern, or other circumstance that could affect your safe participation.
You should stop participating and notify the instructor if you experience pain, dizziness, shortness of breath, or unusual discomfort. Red Phoenix Ballroom does not provide medical advice, diagnosis, treatment, or physical therapy.
Students are responsible for wearing appropriate footwear and following reasonable safety instructions.
9. Personal Belongings
Students are responsible for their personal belongings while attending lessons, workshops, events, or performances. Red Phoenix Ballroom is not responsible for items that are lost, stolen, or damaged, except where responsibility cannot legally be excluded.
10. Respectful Conduct
Red Phoenix Ballroom is committed to maintaining a safe, respectful, and welcoming learning environment.
Harassment, threatening behavior, inappropriate physical contact, abusive language, discrimination, deliberate disruption, or conduct that places another person at risk will not be tolerated. Red Phoenix Ballroom may end a lesson or discontinue services when a person’s conduct is unsafe, abusive, or materially disruptive.
11. Photography, Video, and Media
Purchasing or participating in a service does not automatically grant Red Phoenix Ballroom permission to use a student’s image for advertising or promotional purposes.
Any identifiable photographs or recordings intended for promotional use will be governed by a separate media consent or release, except for incidental appearances at public events where photography or recording has been disclosed.
Students may not commercially record, reproduce, or distribute instruction, choreography, course materials, or another participant’s image without permission.
12. Intellectual Property
The website and its original text, graphics, videos, instructional materials, choreography materials, branding, and other content are owned by or licensed to Red Phoenix Ballroom and are protected by applicable intellectual-property laws.
Content may not be copied, republished, sold, distributed, recorded, or used commercially without prior written permission. Students may use materials provided to them for their own personal dance education.
13. Website Information
We make reasonable efforts to keep website information accurate and current. However, prices, availability, descriptions, schedules, and promotional offers may be corrected or updated at any time.
Website content is provided for general informational purposes and does not constitute medical, legal, or other professional advice.
The website may contain links to third-party platforms. Red Phoenix Ballroom is not responsible for the content, security, availability, or privacy practices of third-party websites or services.
14. Limitation of Liability
To the fullest extent permitted by law, Red Phoenix Ballroom will not be liable for indirect, incidental, special, or consequential damages arising from the use of this website or participation in its services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits any nonwaivable consumer right.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be handled in an appropriate court located in Orange County, California, unless applicable law requires otherwise.
Before initiating formal proceedings, both parties are encouraged to make a good-faith effort to resolve the concern directly.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
